Council waives tax fees for local non-profit organization

Rocky View County (RVC) council received a request on June 27 from Mary Anne Cairns on behalf of the Dalroy Gymkhana Club that the municipal tax portion of the 2014 Tax Levy be cancelled, as the subject properties are leased by the non-profit, community-based organization. The lands, located off Range Road 271 and Township Road 252, have been leased to the club for the past 20 years, and have previously been exempt from municipal taxes by RVC council.

Council retains the ability to cancel taxes through section 347 of the Municipal Government Act. In accordance with the recommendation of administration, Councillor Earl Solberg made a motion to cancel the 2014 Municipal Tax Levy in the amount of $602.32. The motion was unanimously approved.

Passing Third Reading

Third and final reading was given to redesignate a portion of lands located on Range Road 52, approximately 4.8 km northwest of the Hamlet of Bragg Creek and 0.8 km north of Township Road 234 from Ranch and Farm District to Residential Three District.

The redesignation was requested by Lynne and Stephen Gibson in order to facilitate the future creation of a 19.7-acre parcel with a 140.3-acre remainder. The subject site is included in the Greater Bragg Creek Area Structure Plan.

“This first parcel out was presented to council on July 29, 2014, and the bylaw received first and second reading, but did not receive a unanimous approval for a third reading,” said Ugo Ufoegbune, with RVC planning and development services.

Councillor Liz Breakey made a motion to give the bylaw third reading and councillors voted 8-1 with Councillor Lois Habberfield in opposition. The motion was carried.

Land Redesignation

RVC council unanimously approved an application to redesignate subject lands from Ranch and Farm District to Agricultural Holdings District and Ranch and Farm Two District, in order to accommodate the future subdivision of a 20-acre parcel (Lot 1) with a 59.37-acre remainder (Lot 2) on Sept. 23.

The land is located approximately 9.5 km southwest of the Hamlet of Bottrel and 0.8 km north of Township Road 274, on the east side of Horse Creek Road, and is not located within the policy area of an area structure plan or conceptual scheme.

Lot 2 currently contains a dwelling with associated service infrastructure provided by means of a septic field and water well. Lot 1 is undeveloped, but will be serviced the same way.

RVC administration said the application is consistent with the agricultural requirements of the statutory policy, and has been evaluated in accordance with the County Plan.

Councillor Bruce Kendall made a motion for first reading, which was carried unanimously. Councillor Rolly Ashdown made a motion for a second reading, which was also carried unanimously. Breakey made a motion to proceed to third and final reading, and upon unanimous approval, Habberfield made a motion to give the bylaw final reading. The motion was carried unanimously.

Subdivisions

RVC council voted in favour of an application to create a 20-acre parcel with a 80.47-acre remainder on lands located on the southeast side of the intersection of Highway 40 and Township Road 264 (Beaupre Creek Road).

Two dwellings and associated accessory buildings are located on land, with the northern dwelling to be wholly contained on the proposed new lot. Each dwelling is serviced by an existing well and septic field.

Access to the northern lot is gained from an existing approach from Township Road 264, and the other dwelling gains access from an approach off Highway 40. Alberta Transportation will allow the Highway 40 access to remain, but will require a caveat to be registered at subdivision along the western portion of the proposed new lot.

Kendall made a motion to approve the application and it was carried unanimously.

Another application was approved to adjust the boundaries and reconfigure a 156-acre parcel and a 160-acre parcel, located at the northeast intersection of Range Road 290 and Township Road 290.

Currently, the land contains a dwelling with multiple accessory buildings (Lot 1), with no buildings on the proposed northern parcel (Lot 2), and both lots are accessed via a mutual approach that does not need to be upgraded.

However, a right-of-way plan and access easement agreement is a condition of subdivision approval.

The subject lands are located in an agricultural area of the county and are not within the boundaries of any area structure plan or conceptual scheme, and administration said the application is consistent with County Policy.

A motion to approve the application was made by Deputy Reeve Greg Boehlke, and was carried unanimously.
