RVC Council refuses to waive waiting period

Council unanimously refused to waive the six-month waiting period to resubmit a development permit (DP) application for a refused cannabis facility in the Delacour area, at the regular meeting Oct. 22.

“I think when a decision is rendered by one of our boards, we need to honour that decision,” Coun. Samanntha Wright said. “There is an appeal process, and that is to go to court. I think that administration has this right.”

According to planner Johnson Kwan, the Subdivision and Development Appeal Board (SDAB) refused a previous permit application for the facility on Aug. 22. The facility had been conditionally approved June 25, but an adjacent landowner appealed the decision.

The applicant indicated he intends to re-apply for the same application immediately, Kwan said, as he does not consider the decision to be “fair or based on legitimate understanding of the Municipal Government Act (MGA).”

Kwan noted applicants can apply to the Court of Appeals if they feel a development appeal board has not acted in accordance with the MGA, but the applicant said he preferred to reapply without the need for litigation.

Administration recommended refusing the request, because the applicant proposed to reapply for the same permit without any revisions, despite the SDAB decision.
